Privacy Policy for Iterpro Users

This Privacy Policy regards the processing of personal data made by Iterpro Group International Limited (“Iterpro”) pursuant to the General Data Protection Regulation (GDPR) (EU) 2016/679.
The reference to the ‘Software’ is referred to the data management and data processing software called Football Intelligence ITERPRO available online to Users.
Before accessing and using Iterpro Software it is important to carefully read the information about how Iterpro processes data.
This information is provided to help all Users consciously decide whether to begin to use or continue using Iterpro and to describe how Iterpro uses the data of its Users.
Upon registration and creation of a Software account, Users confirm that they have read the information regarding how Iterpro processes personal data, as well as give Iterpro consent to process your personal data as described below, which is always in compliance with EU legislation.
Data controller
The data controller is Iterpro Group International Limited, with headquarters in 19 Dragon Fly Way, Northampton, United Kingdom, NN4 9EH.
Personal information collected and processing
In order to have access to the Software, you are required to create your own account by disclosing your personal information, among which, as a mere example: name, surname, e-mail address, and telephone number.
Iterpro may collect, store and analyze information about individuals whose data is processed by Iterpro during the use of the Software by the Users (“Users Information”).
This data is controlled by Iterpro’s Users and is processed by Iterpro in accordance with the General Terms and Conditions for the sale and use of the Software (“Terms and Conditions”).
As long as Iterpro collects, stores and analyses Users Information it does so on behalf of its Users and it is only a data processor.
Use of the Users Information collected by Iterpro
Users Information will be used by Iterpro in accordance with User’s instructions, including any applicable terms in the Terms and Conditions, and as required by applicable law.
Iterpro collects and processes the following types of personal data that it controls in order to (i) update and improve the Software. This includes the use of data to support the delivery of the Software under the Terms and Conditions, prevent or address service errors, security or technical issues, analyze and monitor usage, trends, maintenance, technical support, and other activities; (ii) investigate fraud. Iterpro works to keep the Software secure and to prevent abuse and fraud. Such processing is the Iterpro’s legitimate interest to keep the Software safe and secure; (iii) for researches purposes. Iterpro uses anonymized and aggregated data for business purposes such as performing research on specific subject-areas as well as statistical analysis and machine-learning, market analysis and producing reports. This Policy is not intended to place any limits on what Iterpro does or can do with data that is anonymized and aggregated so the data is no longer associated with and can no longer be linked to an identifiable customer of the Software, or athlete whose data we have been provided with by a User.
Share of Users Information collected by Iterpro
The User Information, collected and processed by Iterpro, will be made accessible exclusively to subjects that will be appointed for the processing of such data. The Users Information could be disclosed to the following categories. Companies controlled by, controlling or under common control with Iterpro or its affiliates. Iterpro may disclose information to other companies controlled by, controlling or under common control with Iterpro or its affiliates, or service providers specifically identified and authorized by Iterpro or other subjects with which Iterpro has entered into cooperation agreements in relation to the Software or the provision of services covered by the Software. The above-mentioned categories of subjects will process data only within the limits of what will be required to provide, on behalf of Iterpro, the services as well as complementary and indispensable services necessary to use the Software and in any case, always in accordance with the requirements described in this Privacy Policy and in full compliance with Italian and EU legislation. Iterpro will not disclose personal information collected from you, except for the subjects indicated above.
Legal Basis for processing the Users Information by Iterpro
To the extent that Iterpro’s processing of data is subject to the EU and Italian legislation, Iterpro relies on a number of legal bases to collect and use the information for purposes described in this Privacy Policy, including (i) as necessary to provide the Software and to perform the Terms and Conditions; (ii) where Users have consented to the processing, which you can revoke at any time; (iii) where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims; (iv) as necessary for Iterpro’s legitimate interests or those of a third party. Where Iterpro relies on a legitimate interest to process Users Information it relies on, these are (i) to create, provide and maintain innovative the Software; (ii) to secure the Software.
Data Storage
Your personal data are managed through AWS and Microsoft Azure and are stored and processed by means of computerized procedures on a secure server and database localized in the European Union.
For safety reasons, a backup of Users’ Information will be made on a daily basis.
Iterpro undertakes to take all measures necessary for the security of the Users Information collected and guarantees that the processing of Users Information is carried out in strict compliance with applicable EU legislation.
Please remember that User accounts are protected by the password you have been given upon registration and account creation on the Software.
Users are the sole responsible for the security of your password and must be careful and keep the password secret and strictly private.
All the partners and collaborators of Iterpro employees are subject to strict contractual confidentiality obligations that are consistent with this Privacy Policy and may be disciplined or terminated if they fail to meet these obligations.
Industrial Property Rights
The User agrees and acknowledges that the Software used to provide the service and the management of the platform are owned by Iterpro, who owns all legal right, title, interest in and to the service.
The Software contains confidential information and data protected by national and international laws on copyright, trade secrets and other intellectual property rights (Materials), which are the exclusive property of the and the Client agrees to comply with all such laws.
For the avoidance of any doubts, all reports, data, records, statistics, graphs, results, databases or material generated from the analysis conducted by the Software is exclusively owned by Iterpro.
To the extent that any such material could in any way de deemed created by the User, the User hereby assigns all right, title and interest in such material to Iterpro.
Any reproduction, distribution or transmission of the Software and of the Materials without the prior and express written consent of Iterpro is prohibited.
Any reproduction, distribution, modification, creation of derivative works, redistributions or retransmission of the Software is expressly prohibited and will result in severe civil and criminal penalties. The Software, its structure, data, organization and source code are considered trade secrets of Iterpro and are protected by law.
Without prejudice to the above, the copying or reproduction of the Software and its data to any other server or location for further reproduction or redistribution is strictly prohibited.
Limitation of Liability
The User expressly recognizes that the use of the Software and of the service provided by Iterpro is under its own risk.
In particular, all the information and data are provided “as is” and “as available”.
Iterpro does not warrant the User that the service will meet its requirements and that the use of the Software will be uninterrupted, timely, secure, or free from error.
Iterpro will not be liable for any direct, indirect, special incidental or consequential loss or damage which may arise in respect of the Software and its use.
Iterpro will not be liable for any loss of profit, business revenue, goodwill or any other losses in which the User may incur as a result of the use of or reliance upon any information, data or content of the Software.
Your rights
Users have the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (portability); (iii) correction of your personal data if it is incomplete or inaccurate; or (iv) deletion or restriction of your personal data in certain circumstances provided by applicable law. These rights are not absolute. Where we have obtained your consent for the processing of your personal data, you have the right to withdraw your consent at any time.
You can exercise your rights as described above at any time by writing to Iterpro at info@iterpro.com.
At the same e-mail address, you can make any request for clarification in regard to the processing of Users Information or the Iterpro Privacy Policy, as well as any requests for the deletion of Users Information.
Notification of changes
The abovementioned information on the processing of Users Information can be modified and/or updated at any time.
Iterpro will promptly inform you when significant changes are made in the processing of Users Information by e-mail. You are still required to periodically verify the Privacy Policy, which is always available at the web address: https://iterpro.com/.
